(A) The penalty for the first violation of any regulations or Code Chapter set forth herein and disposed of through the Violations Clerk shall be $25. The penalty for a second violation of the same regulation within the same calendar year shall be $50. The penalty for a third or subsequent violation of the same regulation within the same calendar year shall be $100.
(B) The penalties prescribed in § 35.03(A) shall apply only when an alleged violator elects to admit a regulation or code violation and pays the prescribed fine to the Violations Clerk. Section 35.03(A) shall not amend or supersede any other penalty sections of the Atlanta Code of Ordinances including, but not limited to, the abatement of nuisances, issuance and revocation of licenses, the right of the town to file liens against personal and real property, the destruction of the town's property, the right of the Atlanta Police Department to declare and dispose of abandoned and/or junk vehicles, the enforcement of Title XV of the Code of Ordinances entitled Land Usage, and the right of the town, the Atlanta Plan Commission, and/or the Atlanta Board of Zoning Appeals to seek preliminary and/or injunctive relief in a court of law. In the event of a violation of the town's Code of Ordinances including, but not limited to, weeds, nuisances, abandoned and/or junk vehicles, illegal sewer and water tap-ins, zoning, subdivision control, and land usage, the Department, Agency, Commission, Board, Council, or the person empowered by federal, state, and local statutes, ordinances, rules and regulations, in the application and enforcement of the said statutes, ordinances, rules and regulations shall, in its sole discretion, make a determination as to whether to apply and enforce the penalty prescribed in § 35.03(A) or to proceed under any other penalty sections of the Atlanta Code of Ordinances. If the enforcement entity makes a determination to proceed under any other penalty section of the Atlanta Code of Ordinances, then the schedule of penalties set forth in § 35.03(A) hereof and the payment of the same to the Violations Clerk shall not apply.
