The nuisance abated by the Plumbing Inspector at the expense of the township shall be at the cost of the builder or owner of the real estate on which the cesspool is located, and the cost of such abatement or removal shall be paid for by the builder or owner and, in default of payment of such cost after having been billed therefor by the township, the sum shall be collected either by a suit in assumpsit or under the provisions of the Municipal Claims and Liens Act, being 53 P.S. §§ 7101 et seq. Such remedy shall be in addition to the penalty provided in § 1040.99.
