§ 1020.08 BACKFILLING; RESTORATION.
   (a)   All openings or breaks shall be backfilled immediately by the person to whom a permit has been issued, with suitable materials thoroughly compacted and in all respects in accordance with the Aston Township Pavement Restoration Detail Requirements, which are available in the Township Code Enforcement Office. Sidewalks, curbs and gutters shall be replaced in the same condition they were in before the opening or breaking.
   (b)   If any settlement or depression occurs within a period of 18 months from the date of completion, the person to whom the permit has been issued shall, upon notice, apply sufficient additional material, in accordance with township specifications to bring it flush with the adjoining surface of the road. Any expense incurred by the township in correcting the depression or settlement, shall be borne by the person to whom the permit has been issued.
   (c)   The person to whom a permit has been issued shall be required, at his or her expense, to complete the restoration of the surface of any street which has been broken, opened and/or excavated to complete the work for which the permit was issued. Such work of restoration shall be done in accordance with the Aston Township Pavement Restoration Detail Requirements. The person to whom the permit has been issued shall notify the township within five days after the work of restoration has been completed in order that it might be inspected for the purpose of determining if the work of restoration has been satisfactorily done. If any defect appears in the area so restored at any time after the completion of the work, such defect shall be corrected by the person to whom the permit has been issued within five days after notice from the township that repairs are necessary.
   (d)   If, and to the extent any applicant shall open or excavate any portion of a street in a manner which results in 24 square feet or more of such street being excavated on one side of the street only, then the applicant shall be required to repave the street through the full length of the excavations from the center line of the street to the curb on the side of the street upon which the excavation occurred; if all or a portion of the excavations (which result in 24 square feet or more of a street being excavated) either cross the centerline or exist on both sides of the street, in that event, the applicant shall be required to repave the entire street surface from curb to curb, for the length of the excavations. This restoration includes the excavated area, in addition to any additional disturbance of the street, curb, sidewalk or lawn as a result of the project.
