§ 1876.99 PENALTY.
   (a)   Whoever violates or fails to comply with any of the provisions of this chapter shall:
      (1)   For a first offense, be fined an amount set forth by the Board of Commissioners in the fee resolution, and pay the cost of prosecution;
      (2)   For a second offense within a 12-month period, be fined an amount set forth by the Board of Commissioners in the fee resolution, and pay the cost of prosecution;
      (3)   For a third offense within a 12-month period, be fined an amount set forth by the Board of Commissioners in the fee resolution, and pay the cost of prosecution;
      (4)   For more than three offenses within a 12-month period, be fined an amount set forth by the Board of Commissioners in the fee resolution, and pay the cost of prosecution; or
      (5)   For default on an imposed fine, be imprisoned not more than 30 days.
   (b)   A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues after the period stated for correction in the notice of violation provided for in § 1876.04.
