§ 1860.05 GARBAGE AND RUBBISH.
   (a)   Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning and as used in this section or in rules and regulations promulgated by the Board of Township Commissioners under authority of this Health and Sanitation Code.
      GARBAGE. All or any refuse from animal, fruit or vegetable matter or other foodstuffs after it is used as food; all or any refuse from animal, fruit or vegetable matter which was intended to be so used; all or any refuse from markets, stores, dwelling houses, apartments, hotels, restaurants, hospitals, commission houses and eating places; all or any kitchen waste or table waste of animal, fruit or vegetable matter, meats, fish, bones or fat; and all or any offal.
      RUBBISH. Residue from fire used for cooking or for heating purposes; combustible materials such as paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding, noncombustible materials such as tin cans, metal, furniture, dirt, glass crockery and other mineral refuse, and any and all things except garbage.
   (b)   Collection. All ashes, rubbish and waste or other materials placed on streets, highways or private property for the purpose of collection shall be securely packaged, tied and confined so that the same do not and cannot scatter. Such materials, when placed for municipal collection, may be so placed not earlier than 12:00 noon the day prior to collection. Sturdy plastic bags shall be an acceptable receptacle for such materials.
   (c)   Storage of garbage.
      (1)   All garbage shall be at all times kept in water-tight receptacles securely covered with tightly fitting lids, securely fastened thereon.
      (2)   No person shall throw, cast or deposit any garbage or rubbish into or on any gutter, street, highway, public place, vacant lot, watercourse or private property, nor shall any person accumulate garbage or rubbish upon property owned, leased or occupied by him or her, nor shall any person allow the same to be done by another. However, the Board of Township Commissioners may grant a license to maintain a dump, which license shall authorize a licensee to maintain such dump during the term of the license or until the license is revoked. Licenses issued shall be revocable upon 30 days notice to the licensee, or to the person in charge of the premises of the licensee for the time being, or by posting a notice at the site of the dump.
      (3)   It shall be the duty of every owner, tenant, lessee or occupant of every dwelling, tenement, lodging house, hotel, store, restaurant and/or boarding house at all times to provide and cause to be kept in a place readily accessible for removal and emptying a sufficient number of covered receptacles for receiving and holding, without leakage, all garbage or liquid substances derived therefrom that accumulate on such premises between periods of collections and also to provide a sufficient number of receptacles for receiving and holding rubbish between periods of emptying. No person not authorized for the purpose shall interfere with the receptacles or with the contents thereof.
   (d)   Transporting of garbage. No person shall transport or carry any garbage on or over any highway in the township in a vehicle other than one with a metallic water-tight body covered with a tightly fitting metallic lid or canvas cover sufficient to prevent the escape of odors or of any solid or liquid matter. Such lid shall be kept closed or such canvas cover shall be kept in place at all times, except when the vehicle is being loaded and unloaded.
