Words and terms not defined herein but which are defined in the Building Code (Chapters 1420 through 1430) shall have the meanings ascribed to them therein. Words and terms not defined herein or in the Building Code shall have their ordinarily accepted meanings and such as the context herein may indicate. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DETERIORATION. The exterior condition of a building, or part thereof, characterized by holes, breaks, rotting, crumbling, cracking, peeling, rusting or any other evidence of physical decay, resulting from neglect, inadequate maintenance, excessive use or weathering.
EXPOSED TO PUBLIC VIEW. Any building or premises, or part thereof, which may be lawfully viewed by the public from a public street, sidewalk or way.
EXTERMINATION. The control and elimination of insects, rodents, vermin and other pests.
GARBAGE. Putrescible animal and vegetable wastes which result from the handling, preparation, cooking and consumption of food or other organic materials.
INFESTATION. The presence of insects, rodents, vermin or other pests on the premises, which constitutes a health hazard.
NUISANCE. Includes the following:
(1) Any public nuisance known at common law or in equity jurisprudence, or as provided by the statutes or regulations of the commonwealth or the ordinances or regulations of the county or the township;
(2) Any attractive nuisance which may prove detrimental to the health or safety of persons in a building, on the premises of a building or on an unoccupied lot, including, but not limited to, abandoned wells, shafts, basements, excavations, abandoned refrigerators, motor vehicles or other equipment, and trash or debris, which may prove hazardous to inquisitive persons; and
(3) Unsanitary conditions or anything dangerous to health, in violation of this chapter.
OPERATOR. A person who has the charge, care or control of a building or premises, or a part thereof, with or without the knowledge and/or consent of the owner.
OUTSIDE PREMISES. The open space on the premises outside of any building thereon.
OWNER. A person who, alone, jointly or severally with others, has a legal or equitable title to any premises, with or without the accompanying actual possession thereof, or who has the charge, care or control of any premises, as an owner or as an agent of the owner, as an executor, administrator, trustee, receiver or guardian of the estate or as a mortgagee in possession, regardless of how such possession was obtained. A person who is a lessee subletting or reassigning any part or all of any premises shall have joint responsibility over the portion of the premises sublet or assigned by such lessee.
PREMISES. A nonresidential lot, plot or parcel of land, including the building or structures thereon, which is subject to this chapter.
PUTRESCIBLE. Liable to undergo putrefaction, to become rotten and foul-smelling.
REFUSE. All putrescible and nonputrescible solid waste (except body waste) including, but not limited to, glass, garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial wastes.
RUBBISH. Includes nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials.
WEATHERING. Deterioration, decay, rotting or damage, caused by exposure to the elements.
