§ 1460.04 MINIMUM STANDARDS FOR BASIC EQUIPMENT AND FACILITIES.
   (a)   Water service:
      (1)   All newly constructed structures and all dwellings, dwelling units and structures where there has been a transfer of ownership by deed, when located on or adjacent to a street in which a public water main is laid, shall connect to and use the public water supply, within 90 days of the deed transfer. Additionally, if in the opinion of the Plumbing Inspector or Deputy Health Officer, the existing well has collapsed, or the existing water source has otherwise become unsafe or insufficient, the said property owner shall connect to and use the public water supply within 90 days of notice from the Plumbing Inspector;
      (2)   Water shall be distributed through the building so as to furnish adequate quantities of wholesome water with reasonable facilities for chinking and washing purposes for occupants thereof; and
      (3)   Waiver requests of this requirement shall be submitted to the New Construction Committee for review and recommendation to the Board of Commissioners. Final decision of such requests shall rest within the sole discretion of the Board of Commissioners. Any person aggrieved by any decision of the Board of Commissioners relevant to the provision of this chapter may, within 30 days of the Board of Commissioners’s decision, appeal to the Delaware County Court of Common Pleas.
   (b)   All dwellings and dwelling units so located that a public water supply is not accessible shall be furnished with a water supply which meets the requirements of this Housing Code. Such water supply shall also be so distributed through the building so as to furnish an adequate quantity of potable water, with reasonable facilities for drinking and washing purposes, for the occupants thereof. All occupied dwellings not serviced by the public water supply shall be provided with an individual water supply.
   (c)   Sewer service:
      (1)   All newly constructed structures and all dwellings, dwelling units and structures where there has been a transfer of ownership by deed, when the said property is located on or adjacent to a street in which a public sewer main is laid, shall connect such property with such public sanitary sewer within 90 days of the deed transfer, and shall use the same in such manner as the township may require;
      (2)   Additionally, if in the opinion of the Plumbing Inspector or Deputy Health Officer, the existing septic system has failed or the existing onsite waste treatment system is insufficient or presents a health concern to the property or the adjacent properties, the said property owner shall connect to and use the public sanitary sewer within 90 days of notice from the Plumbing Inspector; and
      (3)   Waiver requests of this requirement shall be submitted to the New Construction Committee for review and recommendation to the Board of Commissioners. Final decision of such requests shall rest within the sole discretion of the Board of Commissioners. Any person aggrieved by any decision of the Board of Commissioners relevant to the provision of this chapter may, within 30 days of the Board of Commissioners’s decision, appeal to the Delaware County Court of Common Pleas.
   (d)   Every dwelling unit shall contain a kitchen sink, a water closet, a hand lavatory and a bathtub or shower all of which shall be in good repair and working condition. Every kitchen sink, hand lavatory and bathtub or shower shall be properly connected and supplied with both hot and cold running water.
   (e)   The owner of a building or dwelling, or his or her agent in charge thereof, wherein two or more tenants shall have common use of a toilet, shower or privy, shall be responsible for the maintenance of such toilet, shower or privy. These must be kept in repair and in a clean and sanitary condition.
   (f)   All garbage and rubbish must be kept in a clean and sanitary manner and stored in approved water-tight containers of not more than 30 gallons capacity with tightly fitting lids. The operator of a multiple dwelling shall provide proper containers and shall provide for the removal of garbage and rubbish from the premises so as to maintain satisfactory sanitary conditions.
   (g)   Every dwelling shall have water heating facilities which are properly installed and maintained in safe and good working condition, properly connected and capable of heating water to such a temperature as to permit an adequate amount of water to be drawn at every required kitchen sink, lavatory basin, bathtub or shower at a temperature of not less than 120°F. Such supplied water heating facilities shall be capable of meeting the requirements of this subsection (g) when the dwelling or dwelling unit heating facilities are not in operation.
   (h)   Every dwelling unit shall have two safe, unobstructed means of egress leading to safe and open space at ground level.
