(a) Private swimming pools and hot tubs shall be completely surrounded by a fence or barrier at least 48 inches in height above the finished ground level measured on the side of the barrier away from the pool. Gates and doors in such barriers shall be self-closing and self-latching. Where the self-latching device is less than 54 inches above the bottom of the gate, the release mechanism shall be located on the pool side of the gate. Hot tubs that have a manufacturer installed or provided lid are not required to have fencing.
(b) The Police Department is hereby charged with the duty of notifying the Building Inspector of all excavations for private swimming pools now existing, constructed or maintained within the township or hereafter to be made. The Building Inspector shall immediately send notice of this chapter of the owner, lessee, occupier or user of the premises requiring such person to comply with the provisions of this chapter and to erect a fence.
(c) Such erection shall be made within 48 hours from the receipt of such notice. Service of the notice may be made personally, by registered mail by leaving the notice at the habitation of the person charged and in the event that service in the foregoing manner is not accomplished then by posting the premises with a notice of this chapter.
