For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
HOT TUB. Any whirlpool, hot-tub, spa pool, endless pool or similar device, which is designed for relaxation or recreational use, where the user is sitting, reclining or at rest and the pool is not drained, cleaned or refilled after each use, which shall include, but not be limited to, hydrojet circulation, hot water, cold water or mineral baths or air-induction bubbles, in any combination, and is operated by the property owner where located, regardless of whether a fee is charged.
PRIVATE SWIMMING POOL. Any body of water, tank or receptacle for water, whether artificially constructed or semi-artificially constructed, used or intended to be used for swimming or bathing solely by the owner, operator or lessee thereof and his or her family and by friends invited to use it without payment of any fee and constructed, installed, established or maintained inside or outside any building in or above ground upon any premises as an accessory use to the residence. Hot tubs and portable pools under 24 inches in depth are excluded from this definition.
