(a) The transfer of sick leave from any public agency to the City of Ashtabula shall be in accordance with Section 124.38 of the Ohio Revised Code.
(b) The transfer of sick leave to the City of Ashtabula from another public agency shall not be used for the accumulated sick leave hours needed to participate in the City of Ashtabula’s Annual Sick Time Buyout Program or Sick Time Buyout provisions under employees’ collective bargaining agreements (i.e. FOP, Lodge 26, AFSCME, Local 1197, and IAFF, Local 165). Previous participation in the Sick Time Buyout Program does not entitle further participation unless minimum hours needed to participate are earned in the employ of the City of Ashtabula.
(c) The payment of unused sick leave upon retirement or death will be in accordance with the employees’ collective bargaining agreements or policy set forth for non-collective bargaining employees, with the minimum standards as outlined in Section 124.39 of the Ohio Revised Code.
