(a) Except as limited by subsections (b) and (c) hereof, employees and officials of the City, other than elected officials, are generally free to reside anywhere, preferably within the State of Ohio.
(b) To ensure adequate response times by certain employees to emergencies or disasters while ensuring that those employees generally are free to reside throughout the State, any individual employed by the City of Ashtabula in any capacity in the Police Division, Fire Division, Public Work Division or Water Pollution Control must reside either in Ashtabula County or in any adjacent county in this state, to-wit: Lake, Geauga or Trumbull County. This provision shall apply equally to full-time, part-time, temporary and permanent employees of said Divisions.
(c) Residency in accordance with the foregoing requirements must be established within thirty (30) calendar days of the date of hire or appointment. Compliance with the terms of this section is a mandatory condition of continued employment by the City of Ashtabula. Any person determined to be in violation of this section shall be subject to immediate removal from his or her position by the appointing authority. In the event the appointing authority fails or refuses to remove the person, the City Director of Finance is to withhold all pay and benefits from such person until such removal is accomplished.
