317.99 CIVIL PENALTY.
   (a) Unless the operator of a vehicle receives a traffic citation from a police officer or law enforcement officer at the time and location the violation occurs, a civil penalty in the amount of one hundred dollars ($100.00) shall be assessed against the vehicle owner for the commission of a violation as defined in Section 317.01 .
   (b)   A violation for which a civil penalty is imposed under this Section shall not be considered a traffic offense or a moving violation for the purpose of assessing points under Ohio R.C. 4507.021 and shall not be reported to the Bureau of Motor Vehicles of any state.
   (c)   The failure to respond to a "Notice of Liability" in accordance with Section 317.03 (f) shall constitute a waiver of the right to contest liability for the violation as provided by Section 317.04 .
   (d)   If the vehicle owner fails to respond to the Notice of Liability within the period set forth in 317.03 (f), or the penalty provided in this Section remain unpaid for more than 90 days after the date on which the Notice of Liability was sent, the penalty shall be collected together with interest thereon at the rate of ten percent (10%) per annum from the date of violation, by civil suit or other appropriate means of collection.
