1365.03 FLOOR SPACE AND GENERAL OCCUPANCY.
   (a)   Floor Space Based on Occupancy.
      (1)   Every dwelling unit shall contain at least 150 square feet of floor space for the first occupant thereof and at least 100 additional square feet of floor space for every additional occupant, in addition to the floor area included in water closet compartments, bathrooms, halls or passageways.
      (2)   Every room occupied for sleeping purposes shall contain at least seventy square feet of floor space for one occupant or fifty square feet of floor space for each occupant if more than one.
   (b)   Access to Sleeping Rooms. No dwelling or dwelling unit containing two or more sleeping rooms shall have such room arrangements that access to a bathroom or water closet compartment intended for use by occupants of more than one sleeping room can be had only by going through another sleeping room; nor shall room arrangements be such that access to a sleeping room can be had only by going through another sleeping room or a bathroom or water closet compartment.
   (c)   Ceiling Height of Habitable Rooms. At least one-half of the floor area of every habitable room shall have a ceiling height of not less than seven and one-half feet. The floor area of any part of a room where the ceiling height is less than five feet shall not be considered as part of the required floor area.
   (d)   Basement or Cellar Occupancy.
      (1)   No basement space shall be used as a habitable room or dwelling unit unless:
         A.   The floor and walls are impervious to leakage of underground and surface runoff water, and are well-drained and protected against dampness;
         B.   The total window area in each room is not less than ten percent (10%) of the floor area of the room as measured between stops and is entirely above the grade of the ground adjoining each window area. Window wells or areaways may be substituted on approval of the Housing Inspector, provided such window wells are capable of providing light and ventilation over the entire area of the window, and are of sound design so as to prevent surface drainage into the windows;
         C.   The total openable window area of each habitable room is forty-five percent (45%) of the required window area. A standard mechanical ventilating system may be used in lieu of openable window area on approval of the Housing Inspector;
         D.   All heating equipment or other equally hazardous equipment is separated from the dwelling unit by a standard partition of fireproof design; and
         E.   Access can be gained to the unit without passage through a furnace room.
      (2)   No cellar space shall be used as a habitable room of a dwelling unit.
