(a) A violation of any provision of Part Thirteen, Title Seven of Ashtabula, Ohio's Housing Code or failure to comply with provisions contained therein, including failure to comply with notices issued thereunder, is a misdemeanor of the fourth degree. Each day of violation or failure to comply constitutes a separate offense.
(b) Notwithstanding the foregoing paragraph, no person shall be subject to prosecution, punishment or penalty for refusing to permit an officer or employee of the City to conduct a residential inspection without first obtaining a search warrant.
(c) Nothing in this Section shall be deemed to prevent an officer or employee of the City from seeking a search warrant under Section 2933.21 (F) of the Ohio Revised Code, or other applicable law.
