(a) Ohio Administrative Code 4101:8 - Residential Code of Ohio as promulgated by the Ohio Board of Building Standards, shall apply and be enforced within the City of Ashtabula, Ohio.
(b) This section shall be in full force and effect from and after the earliest period permitted by law following promulgation of the Residential Code of Ohio by the Board of Building Standards through the certification process, adoption and effective date of certification issued by the Ohio Board of Building Standards.
(c) The City Manager is hereby authorized and directed to sign and submit an application to the Ohio Board of Building Standards requesting said Board to certify the City of Ashtabula for enforcement of the Residential Code of Ohio with the condition that the Ashtabula County, Ohio Building Department exercise the enforcement authority as necessary in accordance with the Revised Code of Ohio within the corporate limits of said City and to enter an agreement with the Ashtabula County Building Department for such purpose.
(d) The City Manager be, and he is hereby, authorized to enter into an agreement with the Board of Ashtabula County Commissioners, 25 West Jefferson Street, Jefferson, OH 44047 for the enforcement of the Residential Code of Ohio within the corporate limits of said City of Ashtabula, whereby the Ashtabula County Building Department will exercise all enforcement authority and accept and approve plans and specifications, and make inspections within said City of Ashtabula in accordance with the provisions of the Revised Code of Ohio.
(e) The terms of said Agreement shall grant to the County of Ashtabula full authority to do all things necessary to administer and enforce the Residential Code of Ohio within the corporate limits of the City of Ashtabula, Ohio and in consideration thereof to receive the sum of $0.25 per capita of residents of the City.
(f) Council further agrees to hold Ashtabula County, Ohio, harmless for all claims or causes of action of every kind and nature arising from the lawful acts of the County, its agents, employees and representatives in the administration and enforcement of said Code.
