963.15 LICENSING AND REGULATING COMMERCIAL DREDGING.
   (a)   License Required. No person, firm or corporation owning, controlling, leasing or operating any commercial dredge shall conduct any commercial dredging operation in Ashtabula Harbor without first having obtained a license to do so as hereinafter provided.
   (b)   Application for License. Any person, firm or corporation conducting or intending to conduct commercial dredging operations in Ashtabula Harbor shall file in the office of the City Engineer of the City a written application over the signature of such person, firm or corporation as follows:
      (1)   If the applicant is a person, the application shall be signed by the person, and if the applicant is a firm or partnership, the application shall be signed by each individual composing the firm or partnership. The application shall state the name and residence of each person signing the application, the location of his office, if any, and shall describe the equipment intended to be used in the commercial dredging operation.
      (2)   If the applicant is a corporation, the application shall be signed by the president or secretary thereof, and shall specify the name of the corporation, the date and place of its incorporation, the location of its principal place of business, and shall describe the equipment intended to be used in such commercial dredging operation and shall be accompanied by a copy of its certificate of incorporation.
   (c)   Issuance of Licenses; Fee. Upon filing of the application in the Engineer's office, the Engineer shall, upon payment of an annual license fee of one hundred dollars ($100.00), issue and deliver to the applicant a certificate of license
to engage in commercial dredging operations in the Ashtabula Harbor, which license shall be in a form to be prescribed by the Engineer and shall specify the name of the applicant, the location of the place of business of the applicant, the date on which it is issued, and the date on which it will expire.
   (d)   Expiration of License. All licenses, including those now issued shall expire at midnight on December 31 of each year subsequent to the date of issue, and no license shall be issued for any period of time less than a year or for a sum less than one hundred dollars ($100.00).
   (e)   Disposition of Fees Received. All moneys received as license fees under the provisions of this section shall be paid into the City Treasury and credited to the General Fund.
   (f)   Limitation on Dredging Operations; Restricted Areas. Except upon special permit issued by the City Engineer, as hereinafter provided, commercial dredging operations in the Ashtabula Harbor are limited and restricted to areas, designs and operations consistent with the rules and regulations promulgated by the Port Authority.
   (g)   Special Permit for Dredging in Restricted Areas. Special permits for commercial dredging in restricted areas shall be issued to licensees under this section by the Engineer upon recommendation of the harbor master and approval of the Port Authority. Requests for such permits shall be submitted to the harbor master with suitable drawings giving details of requested operations and the time estimated as necessary to accomplish the same and upon favorable recommendation by the harbor master, shall be submitted to the Port Authority for its approval or rejection.
   (h)   Reports to Harbor Master. Licensees hereunder shall furnish to the harbor master, at the time of their submission to the State and the U.S. Corps of Engineers, copies of all requests for permits to dredge in the Ashtabula Harbor together with copies of tonnage reports of sand and gravel dredged from such harbor.
   (i)   Construction. The provisions of this section shall not be construed to apply to dredging operations of the United States Government, the State, the County, the City or any other branch of government.
