(a) No person shall carry or have in his/her possession any glass containers on the premises of the Walnut Beach Park Area and the Point Park Area, also known as the Overlook Park Area.
(b) For purposes of this section glass containers are defined as glass bottles, glass jars, glass dishes, glass cups, glass tumblers or glass eating containers and glass drinking containers of any type.
(c) For purposes of this section glass is defined as an amorphous inorganic substance consisting of a mixture of silicates or borates or phosphates formed by fusion of silica or of oxides of boran or phosphates with a flax and a stabilizer into a mass that cools without crystallization.
(d) For purposes of this section, possession is defined as the act of having or taking control of property without regard to ownership and regardless of whether such having or taking control occurs outside of or inside a motor vehicle. In the event such possession occurs within a motor vehicle, the operator and/or owner of such motor vehicle shall, in addition to the person or persons actually controlling or possessing such property, be presumed to have control of such property.
(e) Whoever violates subsection (a) hereof shall be guilty of possession of a glass container within the prescribed areas, a minor misdemeanor. If the offender has previously been convicted of a violation under this section, such possession is a misdemeanor of the fourth degree.
