(a) All persons operating vacuum or cesspool pump trucks or other liquid transport trucks for the purpose of emptying or cleaning catch basins, septic tanks, cesspools, sanitary holding tanks, industrial waste holding tanks, oil separators, grit traps, waste equalization tanks and similar facilities within the sewer district or desiring to discharge the resulting waste materials directly or indirectly to the City's sewer system or disposing of such waste materials within the City limits shall have a valid waste pumpers and haulers permit.
(b) Persons requiring a waste pumpers and haulers permit shall first possess a valid certificate of registration from the County Health Officer. They may then apply to the Superintendent of the City by completing the application form, paying the appropriate permit fee, and receiving a copy of the Sewer Use Ordinance Sections 933.08, 933.09 and 933.12 governing use of sewers, prohibitions on wastewater discharges, and septic and industrial waste pumpers and haulers regulations. All applicants shall signify, in writing that they have received and reviewed a copy of the aforementioned regulations and agree to abide by them. The septic and industrial waste pumpers and haulers permit shall be valid for one year from date of issuance. The fee for such permit shall be $150 per year, which shall be paid to the City of Ashtabula prior to the issuance of the permit.
(c) Discharge of septic, sanitary holding tank, cesspool or other wastes of domestic origin may be made by operators holding a waste pumpers and haulers permit to any public sanitary sewer manhole so designated by the City for this purpose upon payment of a disposal fee for each truck load as stipulated in Chapter 937 of the Codified Ordinances.
(1) The City reserves the right to refuse to accept any of the aforementioned wastes at any time when, in the opinion of the Superintendent, such discharge into the sewer system would overload the treatment works or otherwise jeopardize its operation.
(2) In no case shall industrial wastes, sludges, oil separator contents, nor any other waste of industrial origin, nor any wastes prohibited in Section 933.09 be discharged to any public sewer or any part of the wastewater system by the operator of any waste pumping or hauling vehicle.
(3) The rate for discharge of waste accepted by the Superintendent shall be $0.04 per gallon if the number of gallons can be accurately determined, or $.005 per pound by weight. There shall be an additional charge of $5.00 per use of the scale provided by the City.
(d) All operators holding septic and industrial waste pumpers and haulers permits shall maintain accurate and up-to-date manifest records describing in detail all particulars with regard to waste originating within and/or finally disposed within the City and all areas tributary to its sewer system. Such record shall include the following information:
(1) Point of waste origin;
(2) Name and address of origin point owners;
(3) Date of pickup;
(4) Amount of waste by volume or weight;
(5) Description, type or nature of waste;
(6) Point of waste discharge; and
(7) Name and address of discharge recipient.
The records shall be presented to the City each year upon renewal of each operator's septic and industrial waste pumpers and haulers permit and shall also be made available for inspection by the Superintendent at any time he so requests.
(e) Any person violating the City's requirements for the pumping and hauling of septic and industrial wastes may have his permit revoked after written notice of the violation and an opportunity to be heard.
