933.01 TITLE AND APPLICABILITY.

   (a)   Title. This Ordinance shall be known as Chapter 933 of the Codified Ordinances of the City of Ashtabula entitled "Sewer Use Ordinance."

   (b)   Applicability. This Ordinance is applicable to all residential, commercial and industrial users discharging to the City's Wastewater Collection System.

   (c)   Purpose and Policy. This Ordinance sets forth uniform requirements for the connection, maintenance and discharge to the City's Wastewater Collection and Treatment System.

   The objectives of this Ordinance are to:

      (1)   Delineate maintenance responsibilities between the private sector and the City;

      (2)   Define the City's rights including the right to inspect, observe, measure, sample, test and enter upon any facility tributary to the City Sewerage System;

      (3)   Provide procedures controlling material of construction, construction techniques, permit requirements and the chemical composition of discharges;

      (4)   To satisfy the State and federal requirements that the City develop and implement an industrial pretreatment program in compliance with the Clean Water Act of 1977 and General Pretreatment Regulations for New and Existing Sources. 40 CFR Part 403;

      (5)   To prevent the introduction of pollutants into the City's Wastewater System which will interfere with the normal operation of the system or contaminate the resulting municipal sludge;

      (6)   To prevent the introduction of pollutants into the City's Wastewater System which do not receive adequate treatment in the POTW, and which will pass through the system into receiving waters or the atmosphere or otherwise be incompatible with the system;

      (7)   To improve the opportunity to recycle and reclaim wastewater and sludge from the system; and

      (8)   To enforce the City Industrial Pretreatment Program as described in subsections 933.09 thru 933.15; and

      (9)   To protect both POTW personnel, who may be affected by wastewater and sludge in the course of their employment, and the general public.

   (d)   This Ordinance shall apply to the City of Ashtabula and to persons outside the City who, by contract or agreement with the City, are users of the City Wastewater System.

   (e)   This Ordinance shall be effective to the extent not in conflict with other Codified Ordinances of the City. Where this Ordinance conflicts with other administrative regulations, the more stringent of the regulations shall be controlling.
