§ 34.24 RE-EMPLOYMENT.
   (A)   The purpose of this section is to allow the City of Ashland to re-employ trained qualified personnel to the ranks of the Police Department under the following conditions:
      (1)   Applicant left city service in good standing;
      (2)   Applicant was employed for at least one year;
      (3)   Applicant meets all current employment requirements;
      (4)   Be willing to execute a repayment agreement for continued employment with the Ashland Police Department for 60 months, pursuant to KRS 70.290;
      (5)   Re-employment has the recommendation of the City Manager, and approval of the Board of Commissioners;
      (6)   Possess a valid license to operate a motor vehicle;
      (7)   Fingerprinted for a criminal background check;
      (8)   No prohibition on firearm possession Federal or State;
      (9)   Has received and read the Kentucky Law Enforcement Officer’s Code of Ethics;
      (10)   Interviewed by the employing agency;
      (11)   Not have certification as a peace officer permanently revoked in another state;
      (12)   Chief of Police has communicated with head of law enforcement agency that most recently employed the officer to determine whether he or she left that agency due to reasons relating to unfavorable employment;
      (13)   For the purposes of the School Resource Officer Contract Positions and not covered by the collective bargaining agreement, an officer retired in good standing from a Kentucky agency and their certification for peace officer is in good standing considering work history, training, and determination by the Chief of Police as an acceptable candidate; and
      (14)   Retirement positions whether School Resource Officer or back to full duty will be required to possible enter into contracts with the Ashland Independent School District, Kentucky Public Pension Authority, etc.
   (B)   Applicants meeting the aforestated conditions will be required to complete those steps in the testing and evaluation procedures determined by the City Manager to be necessary and appropriate in each particular circumstance based on previous employment history and other pertinent personal information.
   (C)   Applicants that are retired from the City of Ashland Police Department and are also recommended for rehire are allowable. If rehired, guidelines established in KRS 95.022 will be followed. The law restricts the number of retired officers within the agency. A contractual agreement (ADDENDUM A) will be required by all officers pertaining to KRS 95.022 which will be updated yearly.
