(A) Each property or facility is allowed two unwarranted and/or nuisance alarms per 12 month calendar year (January 1 - December 31). Any fire alarm in excess of two is subject to administrative fines. An intentional false alarm will result in a citation.
(1) A warning letter will be sent to the property for both the first and second unwarranted and/or nuisance alarm to inform them of their false alarms (see § 95.34).
(2) Subsequent unwarranted and/or nuisance alarms cannot be counted as the second false alarm until proper notification is delivered. For example, if there were three false alarms during the weekend, the Fire Prevention personnel would notify the property on the following Monday. All three of the weekend alarms would count as one alarm. They will be allowed one additional false alarm before citation.
(B) All incidents involving intentional, unwarranted and/or nuisance false alarms shall be coded according to the National Fire Incident Reporting System (NFIRS).
(C) The NFIRS incident type codes 711 - 745 will count as intentional, unwarranted and nuisance false alarms.
(D) Alarms due to inclement weather will not count as false alarms towards a citation.
(E) Citations will be immediately issued to the responsible party for malicious, mischievous false alarms, bomb scares, or alarm system testing or servicing. Alarms which resulted in a citation to the responsible party will not be counted in the false alarm count for property owners.
(F) Any unwarranted or nuisance false alarms that are the result of a failure to maintain a fire alarm system may be subject to immediate citation for violation for failure to maintain a fire and life safety system in operable conditions at all times.
