§ 99.06 PROHIBITION OF SMOKING IN OUTDOOR ARENAS AND STADIUMS, AND IN THE VICINITY OF THE KDMC.
   (A)   Smoking is prohibited in the seating areas of all outdoor arenas, venues, stadiums and amphitheaters.
   (B)   It shall be prohibited for anyone to smoke within any city right-of-way surrounding any facility of the King's Daughters Medical Center ("KDMC"), except in designated smoking areas. The rights-of-way are noted on the map attached to Ordinance 9-2016 and made a part hereof by reference, and shall also include the rights-of-way of Hilton Avenue, from 23rd to 24th Streets, and 24th Street, from Hilton Avenue to Lexington Avenue. Smoking areas shall be designated by the City Manager, and signs shall be posted designating the smoking areas.
   (C)   Division (B) shall be enforced any City Code Officer or any individual duly sworn to enforce this division and authorized by the city to issue citations hereunder, which may include, without limitation, KDMC security supervisors. Warnings may be issued by any City Code Officer or KDMC security staff.
      (1)   KDMC security officials shall inform persons seen violating this division of its requirements.
      (2)   In the event a security official of KDMC observes a person or persons violating this division, he or she shall immediately direct the person or persons in violation to extinguish the item being smoked.
      (3)   In the event the person(s) violating this division complies with this directive, no violation shall exist.
      (4)   In the event the person(s) violating this division fails or refuses to comply with this directive, the violator may then be cited for the violation.
   (D)   Any person who violates the provisions of division (B) shall be subject to the following penalties:
      (1)   Fifty dollars for the first offense;
      (2)   One hundred dollars for every subsequent offense during a 12-month period.
