AGREEMENT FOR SERVICES
   THIS AGREEMENT ENTERED INTO THIS           day of                 , 20    , by and between the City of Ashland, Kentucky, 1700 Greenup Avenue, Ashland, Kentucky, 41101, hereinafter referred to as the "City" and                                       , Ashland,
Kentucky, hereinafter referred to as the "Applicant",
   WITNESSETH THAT:
   WHEREAS, the Applicant has requested installation or replacement of concrete fronting the property located at                                     , and
   WHEREAS, the City has examined the area abutting the property located at                                and has determined that the installation or replacement of said concrete under the City's Concrete Replacement Program would be both desirable and appropriate;
   NOW, THEREFORE, it is mutually agreed and covenanted by and between the parties hereto that the City agrees to the concrete construction under a Concrete Replacement Program at                                      and the Applicant agrees to pay all or a portion of the construction costs necessary, as defined below, to install or replace the concrete abutting the property at said location, and each and all of the further and mutual covenants and agreements hereinafter set out to be performed by both or either of the said parties, all of which said covenants or agreements, collectively and severally, are mutually agreed to be material and a part of this agreement as follows:
SECTION 1.
   The construction costs for the concrete installation or replacement abutting the property located at                                      has been estimated to cost $                   . The Applicant's cost shall be $              . This cost was calculated in the following manner:
SECTION 2.
   The Finance Department certifies that the property owner is not delinquent on payment of any City property taxes.
SECTION 3.
   The ownership of the construction under this agreement shall at all times be vested in the City, its successors and assigns.
SECTION 4.
   The purpose of this agreement is to install new or replace old, existing sidewalks, driveway entrances, steps, curbs or retaining walls in the public rights-of-way that are in bad repair and not for the purpose of any construction on private property.
SECTION 5.
   The Applicant has attached to this agreement payment in the amount of $                as the Applicant's portion of the estimated cost of the concrete installation or replacement. Payment will be used solely for the anticipated work. The City represents completion of replacement within reasonable time.
SECTION 6.
   The City in no way warrants the workmanship of the concrete contractor, nor the method of installation.
SECTION 7.
   This agreement constitutes the entire agreement and understanding between the parties and shall not be altered or amended by any other oral statements or representatives made by the parties.
