For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ANIMAL CONTROL OFFICER. The person or persons employed by the city as an enforcement officer or officers.
ANIMAL SHELTER. Boyd County Animal Shelter or any other facility designated by the Dog Warden to impound and care for a dog picked up by the Dog Warden for a violation of this subchapter.
AT LARGE. Any animal shall be deemed to be at large when it is off the property of its owner and not restrained by leash with a maximum length of ten feet, or otherwise properly restrained.
CARETAKER. Any person or organization who participates in trap-neuter-return (TNR) and/or who regularly provides care to a community cat.
COMMUNITY CAT. Any cat or kitten that has no apparent owner or identification and is free roaming.
EUTHANASIA. Death brought about by any method which produces instant loss of consciousness and results in painless death.
EXPOSED TO RABIES. An animal has been exposed to rabies within the meaning of this subchapter if it has been bitten by, or been exposed to, any animal known to have been infected with rabies.
FARM ANIMAL. A farm animal is any horse, mule, cow, goat, pig, rabbit, turkey, chicken or other animal or fowl commonly found on a farm.
KENNEL. Any person engaged in the commercial business of breeding, buying, selling or boarding dogs, and/or who owns, harbors, or keeps five (5) or more dogs over the age of four (4) months.
NUISANCE. An animal shall be considered a nuisance if it: damages, soils, defiles, or defecates on private property other than the owner's or on public walks, public areas, parks, and recreation areas unless such waste is immediately removed and properly disposed of by the owner; causes unsanitary, dangerous, or offensive conditions; causes a disturbance by noisemaking, or molests, attacks, or interferes with persons or domestic or farm animals. Any unleashed and/or unvaccinated dog, and any unvaccinated cat shall be considered a nuisance.
OWNED CAT. Any cat that is regularly fed and sheltered in that same person's habitation.
OWNER. Any person having a right of property in an animal or who keeps or harbors any animal or who has an animal in his care or custody.
PARKS. Parks shall be defined as Central Park, Oliverio Park, Dawson Pool Park, Riverfront Park, Spring Park and Southside Park.
PERSON. Any individual, firm, corporation, partnership, association or other legal entity.
QUALIFIED PERSON. A person granted a permit by the Secretary for Human Resources to vaccinate animals against rabies and may include owners or operators of licensed kennels.
RESTRAINT. An animal is under restraint within the meaning of this subchapter if it is controlled by a leash, confined within a vehicle being driven or parked on the streets, confined within the property limits of its owner or keeper or with the consent of the property owner, or confined within a crate or cage.
TRAP-NEUTER-RETURN (TNR). The method of managing community cats by humanely trapping, altering, vaccinating, ear tipping, returning the community cat to the location where they were trapped where the community cats will be provided with long-term care by a caretaker.
VETERINARIAN. A licensed practitioner of veterinary medicine.
VICIOUS ANIMAL. Any animal that attacks and injures or bites and injures a human being or domesticated animal without provocation, or which, because of temperament, conditioning or training has a known or exhibited propensity to bite and injure human beings or domesticated animals, or which constitutes a physical threat to humans or domestic animals.
WILD ANIMAL. Any member of the animal kingdom including those born or raised in captivity except the following: human beings, domestic dogs (excluding hybrids with wolves, coyotes, or jackals), domestic cats (excluding hybrids with ocelots or margays), farm animals, rodents, any hybrid animal that is part wild, and captive bred species of common cage birds.
