(A) The subchapter shall apply to permanent structural and non-structural BMPs in new development or redevelopment projects that disturb greater than one acre, and projects disturbing less than one acre that are part of a larger common plan of development. Projects include lands for residential, commercial, industrial or institutional use, but do not apply to agricultural land management practices. Exemption of agricultural land management practices does not apply to illicit discharges.
(B) The subchapter seeks to ensure that post-construction SWPPP are developed, reviewed and approved and stormwater management facilities are properly maintained through the execution of long-term maintenance agreements and maintenance plans and management practices by property owner(s).
