§ 34.03 PAYMENT OF POLICE PERSONNEL FOR COURT APPEARANCES.
   (A)   All personnel of the Police Department non-exempt shall hereafter be compensated for off-duty appearances before any judicial body arising out of their employment with the city, said judicial bodies to include Boyd Circuit Court, Juvenile Court, Boyd District Court, and in any other judicial proceedings for which the employee was subpoenaed or summoned in the following manner:
      (1)   If the appearance requires four hours or more, including travel time, waiting time and actual appearance, said compensation shall be based upon the hours actually incurred.
      (2)   If the appearance requires less than four hours, including travel time, waiting time and actual appearance, said compensation shall be payment for four hours.
      (3)   All payments shall be based on an hourly charge equivalent to the salary schedule of the involved personnel.
      (4)   Certification of the time expended shall be made by said personnel to the Chief of Police. Payment shall be made after approval by the Chief of Police.
   (B)   This section shall not affect, in any manner, court appearances on days upon which the personnel was regularly scheduled to work, and no additional pay shall be received for court appearances on said on-duty days, except that personnel attending judicial proceedings immediately prior to or immediately after a regularly scheduled tour of duty shall be compensated for that time only at the normal hourly overtime rate as prescribed by Kentucky Revised Statutes. Such compensation shall not exceed the compensation method described in division (A) above.
