§ 50.038 CONDITIONS UNDER WHICH PROPERTY OWNERS MAY LAY PIPE LINES IN STREETS.
   When water connections shall be desired for any property in the city limits situated upon a street or a part thereof where pipe has been laid, and the city shall be unwilling to extend its water mains to the property, the owner of the property may make application to the city for permission to lay a line of pipe from the city water mains to such owner's property. The permit issued to such person shall be in writing, signed by the applicant, and shall be subject to the following conditions, which shall be expressed therein:
   (A)   The person to whom the permit shall be granted shall bear all the expense of laying the pipe line and of connecting it to the city main.
   (B)   The pipe shall be laid according to specifications furnished by the Engineering Department and the work shall be done under the supervision and control of that department.
   (C)   The city shall be saved harmless from all loss, cost, damage and expense by reason of any injury to any person or property as a result of laying of such pipe line.
   (D)   Such pipe line, when completed, shall become the property of the city and be subject to its control.
