7-3-4-3: WASTEWATER DISCHARGE PERMITTING: EXISTING CONNECTIONS:
Any User who 1) is required to obtain a wastewater discharge permit; 2) was discharging wastewater into the POTW prior to the effective date of this chapter; and 3) wishes to continue such discharges in the future, shall, within thirty (30) days after said effective date, apply to the City for a wastewater discharge permit in accordance with Section 7-3-4-5 of this chapter. In this case, the User may continue to discharge during application review and subsequent permit development by the COA. If the User submits a complete permit application within the timeframe required by this section, and the City fails to issue a wastewater discharge permit through no fault of the applicant, the User may continue to discharge to the POTW under the applicable requirements of this chapter.
   A.   Any User required to obtain a wastewater discharge permit who was discharging wastewater into the POTW prior to the effective date of this chapter and who also has an existing wastewater discharge agreement or memorandum of understanding in place with the City, shall be allowed to continue to discharge in the future without further action until ninety (90) days prior to expiration of the agreement or memorandum, at which time the discharger must submit an application for a wastewater discharge permit as set forth in Section 7-3-4-5 of this chapter.
