10-1-9: PROHIBITED ACTS:
   A.   Recording Unapproved Plats: The registration or filing of record by any person of any map, plan, plat or replat contrary to the provisions of this title, or the offering of or the causing to be offered of false information by any person to cause any such map, plan, plat or replat to be recorded or accepted to be recorded contrary to the provisions of this title, shall be unlawful, and such map, plan, plat or replat filed without the endorsement and approval of the city council, the planning and zoning commission, the community development director or the director's designated representative, as the case may be, shall be void.
   B.   Selling Unapproved Lots: Any owner or owner's agent of any land located within the platting jurisdiction of the city of Artesia, who transfers, sells, agrees to sell or negotiates to sell such land by reference to, exhibition of, or by other use of a plat or subdivision of such land before such plat has been approved, as provided in this title, shall be deemed guilty of a misdemeanor for each lot so transferred, sold, agreed to be sold or negotiated to be sold. The description by metes and bounds in the instrument of transfer, or other document used in the process of selling or transferring, shall not exempt the transaction from such penalty. Upon violation of this subsection, the city attorney or other person designated by the city council shall proceed with an appropriate action in the proper court to enjoin such transfer, sale or agreement, or proceed with an appropriate action in a proper court to recover the penalty herein provided by civil action.
