7-4-16: ENFORCEMENT; COMPLIANCE; VIOLATION; PENALTIES:
   A.   Any city police officer, building inspector/code enforcement officer, agent, fire marshal, or any other authorized person, may issue a notice that a citation will be issued for any violation of this chapter. The notice shall be directed to the owner or responsible party of the property on which the violation occurs. Said notice may be issued in person, by notice posted upon the premises, or by regular first class mail. After such notice is issued, correction or abatement of said violation shall be done within forty eight (48) hours from the time of issuance of the notice, at the owner or responsible person's sole expense. In the event of failure to correct or abate said violation within forty eight (48) hours from the issuance of the notice, a citation or complaint against the offender shall be issued for the violation. Additionally, failure to comply with the correction or abatement of said violation shall be deemed to be an additional separate offense for each day for which such violation continues.
   B.   Any person who violates any provision of this chapter shall be deemed guilty of a petty misdemeanor and upon conviction thereof, shall be subject to penalty as provided in title 1, chapter 4 of this code.
   C.   In addition, the city may seek restitution from the owner or responsible party for the costs of all cleanup, removal, abatement, or remediation for any solid, hazardous, or prohibited wastes billed the city. The owner or responsible party for said property will be billed the actual costs for the cleanup, removal, abatement, or remediation by the city, plus a one hundred dollar ($100.00) administration fee. If the amount owed remains unpaid after thirty (30) days after the billing date, a finance charge equal to one percent (1%) per month commencing thirty (30) days after invoice date shall be charged by the city until the account be paid in full, and the city shall have all legal remedies for collection of the amounts owed.
   D.   The city shall additionally have lien rights against a particular property for all amounts which may be owed and unpaid to the city. (Ord. 880, 11-8-2011)
