7-4-14: UNAUTHORIZED USE OF COLLECTION CONTAINERS:
   A.   It shall be the duty of the person/responsible party to remove solid waste from any rights of way within the city. It shall be unlawful for any person to place, or permit another to place, any solid waste inside any collection container at any collection point used in the city for collection service, unless the solid waste is from the premises served by the collection container or from the premises at which the container or collection point is located.
   B.   City collection containers are placed at several points in city areas to provide for solid waste collection from residential and commercial areas, i.e., apartments, businesses, parks, and institutions within the city boundaries for use of city customers only.
No solid waste from outside the city boundaries shall be placed in any city collection containers or on the ground at such locations.
   C.   It shall be unlawful for any person to place or deposit, or permit another to place or deposit, prohibited or hazardous solid waste into or next to any city serviced collection containers.
   D.   The responsible party for any building, house, structure or land shall cause to be removed, at his own expense, all hazardous and prohibited solid wastes which are located, owned, or deposited on the property or on or within the public right of way adjacent to the property within forty eight (48) hours of notice from the solid waste supervisor or code enforcement officer. Notice of the fact may be made in person, posted on the premises, or sent by first class mail. The existence of any hazardous or prohibited materials on the property or within the adjacent public right of way after notice has been given and the required time has expired, shall be prima facie evidence that such person, owner or occupant has failed or refused to remove the item or items so stored or located thereon and shall be held to answer for the violation.
   E.   No person shall deposit or otherwise place in any collection container to be serviced by the city or its contractor, any carcass, offal, or portion of any animal, bird or reptile, including blood of the same. Any person in the city having knowledge of the existence and location of a dead animal, bird or reptile shall immediately notify the animal control officer of the location of such dead animal, bird or reptile and shall provide such information as the animal control officer or agent designated by the city may require.
   F.   It shall be unlawful and a violation of this chapter to deposit any solid waste on the public streets, alleys, or public ways except in proper collection containers; or to deposit such waste on vacant lots or outside of collection containers with the intent to avoid proper collection, or payment for services under the terms of this chapter.
