7-4-10: UTILITY RATES AND FEES:
   A.   Fees: The governing body may from time to time, by resolution, set fees for the use of the transfer station, monthly collection services, and special services offered by the solid waste department. Charges will be levied each month for all utilities offered and any special services requested for the collection and disposal of solid waste, in addition to other city utilities, whether or not the solid waste collection service is actually used. Failure to comply is a violation of this chapter.
   B.   Notice To Stop Services: Continuation of charges set forth by this chapter shall continue until the responsible party or owner of such premises provides notice in writing to the municipal clerk requesting such services be stopped, and after all city issued collection containers have been returned to the solid waste department.
      1.   Vacant premises shall continue to incur charges until all city issued collection containers have been returned to the solid waste department, and the city documents the vacancy through contact with the tenant or the owner.
      2.   Accounts where a collection container has been assigned by the city shall continue to incur monthly fees until the issued collection containers have been returned to and received by the city's solid waste department or the replacement costs for such container are collected.
      3.   Any person making a false statement upon any application or request to stop services pursuant to this chapter shall be in violation of this chapter.
   C.   Rendition Of Bills: The city shall bill persons, responsible parties, firms, corporations, or other legal entities subject to this chapter for all fees and associated costs to said persons residential or commercial account on a monthly billing schedule established by the municipal clerk. Such bills may include, but are not limited to, charges for commercial dumping, use of transfer station, loss or damage to collection containers, special services, water service, sewer service, and garbage collection, and shall be payable upon receipt whether or not the service is actually used. All said bills shall be payable at the office of the municipal clerk or billing office.
   D.   Past Due Bills: Residential and commercial utility accounts, commercial dumping accounts, and any other account established with the city that remains unpaid for over ninety (90) days from the billing date shall be processed for collection by any lawful means; and/or in the event a property be connected for said services and no payment be timely received, then the city may have any recourse against the responsible party or property as provided by law, including, but not limited to, filing a lien against the property for said unpaid indebtedness.
