7-4-6: RESIDENTIAL COLLECTION:
   A.   Residential Container Required; Maintenance Required: Every person or responsible party within the city boundaries shall cause to be provided, on his premises, one or more of the solid waste collection containers in sufficient number to contain all solid waste accumulated by said person between collections. Such containers shall meet the following specifications and be maintained as required:
      1.   Containers shall be provided by the city without exception.
      2.   Containers supplied by the city shall remain the property of and responsibility of the city.
      3.   Containers shall be maintained in mechanically sound condition by the city.
      4.   The city shall be entitled to seek restitution from the responsible party assigned the collection container for all maintenance, repairs, or loss occasioned by the negligent or intentional acts of the person or third parties from which damage has occurred.
      5.   The combined weight of the collection containers and contents shall not exceed one hundred fifty (150) pounds for roll-out carts and one thousand eight hundred (1,800) pounds for large three (3) yard containers.
   B.   Residential Collection Regulations: All collection containers shall be loaded with bagged solid waste only and in such a manner as they will self-empty when inverted. Yard waste is exempt from the bagging requirement.
      1.   Solid waste that is too long or "bulky" to be placed in the collection containers as required by this chapter, shall be prepared for collection by compressing the rubbish as flat as practicable, or by breaking or cutting items into shorter lengths, and securely tying them in a bundle not exceeding four feet (4') in length and fifty (50) pounds in weight. No solid waste such as light packing materials, or other similar and easily scattered materials shall be included in the bundle, nor shall any solid waste or material not defined as rubbish. Such bundles and bulky waste shall be placed as instructed by the city.
      2.   The owner, occupant, tenant, or lessee of each premises shall store the containers in such a manner as to keep the containers from being overturned or upset and scattered in any manner.
      3.   The solid waste supervisor shall notify and advise any person out of compliance with this chapter, in writing by ordinary first class mail or by posting on the premises, and order corrective action as appropriate. If the issue is not corrected within fifteen (15) days of the date of mailing of the notice or posting on the premises, the person shall be deemed in violation of this chapter, and enforcement action may be taken.
   C.   Residential Collection Times, Locations And Frequency:
      1.   The department will determine scheduled pick up days and times, placement locations, and types of collection containers based on routing, safe access, staffing, and equipment available. All residential roll-out containers, other than at a qualified physically disabled residence, shall be placed out for pick up no later than seven o'clock (7:00) A.M. on the regularly scheduled day, but no earlier than seven o'clock (7:00) P.M. the evening prior to pick up unless otherwise authorized by the department.
      2.   Roll-out containers shall be placed as close to the front curb as possible, wheels shall be touching or within six inches (6") of the curb. It shall be placed so the opening faces the street assigned for pick up, without causing interference with pedestrians, vehicular traffic, or fire hydrants.
      3.   Containers shall be clearly visible and accessible to collection equipment and employees, and free from any obstructions including, but not limited to, trees, shrubbery, walls, fences, and vehicles. All emptied containers shall be removed from the curb area within twelve (12) hours of collection.
      4.   Qualified physically disabled residents will contact the solid waste supervisor for a physician approved application. The solid waste supervisor will establish pick up procedures for their current circumstance. (Ord. 880, 11-8-2011)
