7-4-2: ADMINISTRATION:
   A.   Duties Of The Director Of Infrastructure: The director of infrastructure is responsible for the administration and enforcement of this chapter utilizing the solid waste supervisor and the code enforcement officer. It shall be the duty of the director of infrastructure to oversee the handling and collection of all solid waste in the city and disposal or processing thereof. He shall have the authority to adopt rules and regulations to implement this chapter.
   B.   Service Conversions: All service conversions from a current collection system to an alternate service (i.e., roll-out containers to shared containers or shared containers to roll-out containers), shall be recommended by the solid waste supervisor. Should the conversion be approved by the infrastructure director, reasonable notice will be given to the affected customers.
   C.   Size, Location, Quantity And Type Of Service Needed: The solid waste supervisor, under the direction of the director of infrastructure, is responsible for evaluating the size, type of collection container, location, quantity, and type of service or equipment necessary to provide the required services to residential and commercial accounts. In cases of disputes or complaints arising from such decisions, the department shall designate the size, location, quantity, and type of service needed for said containers, taking into consideration among other things, convenience to collection crews, convenience to customers, safety of residents and employees, and if hazardous conditions exist (i.e., electrical wires, etc.).
   D.   Duties Of The Solid Waste Supervisor: The solid waste supervisor shall:
      1.   Monitor residential and commercial compliance as outlined in this chapter.
      2.   Oversee bid or contract work as applicable to the solid waste department.
      3.   Monitor and follow departmental rules and regulations, and meet all city, state, and environmental requirements.
      4.   Hear and decide complaints brought by a person concerning another person's compliance with the terms of this chapter.
      5.   Notify persons whose collection containers are not in conformity with the requirements in this chapter.
      6.   Approve the locations of, and need for, all containers.
      7.   Notify persons if unsanitary conditions exist.
      8.   Resolve disputes regarding placements of solid waste collection containers.
      9.   Order additional residential and commercial pick ups or collection containers, at the responsible party's expense, if unsanitary conditions exist.
   E.   Grievance Procedure: Any person aggrieved by a decision of the solid waste supervisor may appeal first to the director of infrastructure. If the matter is not resolved, then to the infrastructure committee. A final appeal can be brought before the full city council.
   F.   Designation Of Enforcement Authority: The solid waste supervisor may issue notice for lack of compliance or violation of this chapter, and/or the solid waste rules and regulations. Any city police officer, building inspector, code enforcement officer, fire marshal, or any other city employee authorized by the governing body, is authorized to issue citations for any violation of this chapter, and proceed with enforcement.
