7-3-1-1: PURPOSE AND POLICY:
This chapter sets forth uniform requirements for Users of the Publicly Owned Treatment Works (POTW) for the City of Artesia (COA or City) and enables the COA to comply with all applicable State and Federal laws, including the Clean Water Act (33 United States Code (U.S.C.) section 1251 et seq.) and the General Pretreatment Regulations (Title 40 of the Code of Federal Regulations (CFR) Part 403). The objectives of this chapter are:
   A.   To prevent the introduction of pollutants into the City’s POTW that will interfere with its operation.
   B.   To prevent the introduction of pollutants into the City’s wastewater system passing through inadequately treated, into receiving waters, or otherwise being incompatible with the City’s POTW.
   C.   To protect both POTW personnel who may be affected by wastewater and sludge in the course of their employment and the general public;
   D.   To promote reuse and recycling of industrial wastewater and sludge from the City’s POTW.
   E.   To provide for fees for the equitable distribution of the cost of operation, maintenance, inspection and improvement of the City’s POTW.
   F.   To enable the City to comply with its National Pollutant Discharge Elimination System (NPDES) permit conditions, sludge use and disposal requirements, and any other Federal or State laws to which the City’s POTW is subject.
   G.   To provide for the City to regulate discharges into the wastewater collection system through the issuance of permits to certain nondomestic users along with enforcement of general requirements for other users, authorize monitoring and enforcement activities, establish administrative review procedures, require user reporting, and provide feesetting for the equitable distribution of costs resulting from the program established herein.
   H.   All users of the City’s wastewater system are subject to the provisions of this chapter. Users beyond the City’s limit shall comply with this chapter as well as any permits or orders issued hereunder as if located within the COA boundaries and subject to the jurisdiction of the City and courts in the same manner as any discharger located within the City limits.
