A. Penalty: Any person convicted of violating any provision of this chapter shall be subject to penalty, as provided in title 1, chapter 4 of this code, to be imposed by the municipal court of the city. (1996 Code § 12.16.040; amd. 2002 Code)
B. Liability For Resurfacing Expense: In addition to the penalty imposed for violation hereof, the owner of the property from which a swimming pool has been drained into an alley, in violation of this chapter, shall be assessed the actual cost and expense of any grading, filling and resurfacing necessary to restore the alley to its condition prior to such unlawful draining of swimming pool water into said alley. The public works director shall determine the cost of any such repair and restoration and report it to the city clerk-treasurer who shall separately designate and assess same on the next ensuing monthly statement for municipal water, sewer and solid waste collection charges sent to the owner of the property violating any provision of this chapter.
