A. No license shall be issued under this chapter for any sexually oriented business within any zoned district other than the designated industrial district.
B. It shall be a violation of this chapter to operate or cause to be operated a sexually oriented business outside of the designated industrial district.
C. It shall be a violation of this chapter to operate or cause to be operated a sexually oriented business within one thousand five hundred feet (1,500') of:
1. Any church;
2. Any school furnishing compulsory education under the laws of the state;
3. The boundary of any residential district;
4. An existing dwelling unit or residence (single or multiple); or
5. A public park adjacent to any residential district.
D. It shall be a violation of this chapter to operate or cause to be operated a sexually oriented business within one thousand five hundred feet (1,500') of another sexually oriented business.
E. It shall be a violation of this chapter to cause or permit the operation, establishment, or maintenance of more than one sexually oriented business within the same building, structure, or portion thereof. (Ord. 695, 12-14-2004)
