§ 53.017 BUILDING SEWERS AND CONNECTIONS.
   (A)   No unauthorized person shall uncover, make any connections with or opening into, use, alter, or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Clerk-Treasurer.
   (B)   (1)   There shall be two classes of building sewer permits:
         (a)   For residential and commercial service; and
         (b)   For service to establishments producing industrial waste.
      (2)   In either case, the owner or his or her agent shall make application on a special form furnished by the town. The permit application shall be supplemented by any plans, specifications, or other information considered pertinent in the judgment of the Inspector. A permit and inspection fee of $10 for a residential or commercial building sewer permit and $25 for an industrial building sewer permit shall be paid to the Clerk-Treasurer at the time the application is filed.
   (C)   All costs and expenses incident to the installation and connection of the building sewer shall be borne by the owner. The owner shall indemnify the town from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.
   (D)   A separate and independent building sewer shall be provided for every building. Except where one building stands at the rear of another or an interior lot, and no private sewer is available or can be constructed to the rear building through an adjoining alley, courtyard, or driveway, the building sewer from the front building may be extended to the rear building and the whole considered as one building sewer.
   (E)   Old building sewers may be used in connection with new buildings only when they are found on examination and tests by the said Inspector to meet all requirements of this chapter.
   (F)   The building sewer shall be ductile iron soil pipe, DIP; ANSI A21.51 specification or polyvinyl chloride pipe (PVC); ASTM specification or equal; or other suitable material approved by the said Inspector. Joints shall be tight and waterproof. Any part of the building sewer that is located within ten feet of a water service pipe shall be constructed of ductile iron soil pipe with mechanical or O-ring joints or polyvinyl chloride pipe with gasket joints.
   (G)   The size and slope of the building sewers shall be subject to the approval of the said Inspector, but in no event shall the diameter be less than four inches. The slope of such four-inch pipe shall not be less than one-eighth-inch per foot.
   (H)   Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. No building sewer shall be laid parallel to or within three feet of any bearing wall, which might thereby be weakened. The depth shall be sufficient to afford protection from frost. The building sewer shall be laid at a uniform grade and in straight alignment insofar as possible. Changes in direction shall be made only with proper curved pipes and fittings.
   (I)   In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by such drains shall be lifted by an approved means and discharged to the building sewer. No water-operated sewage ejector shall be used.
   (J)   All excavations required for the installation of a building sewer shall be open trench work unless otherwise approved by the Inspector. Pipe laying and backfill shall be performed in accordance with OSHA requirements, except that no backfill shall be placed until the work has been inspected by the Inspector or his or her representative.
   (K)   All joints and connections shall be made gas tight and water tight. No paint, varnish, or other coatings shall be permitted on the jointing material until after the joint has been tested and approved. All joints in vitrified clay pipe or between such pipe and metals shall be made with approving jointing material in accordance with the latest edition of Volume III, Plumbing Rules and Regulations of the Administrative Building Council of the state. Other jointing materials and methods may be used by approval of the said Inspector.
   (L)   The connection of the building sewer into the public sewer shall be made at the “Y” branch, if such branch is available at a suitable location. If the public sewer is 12 inches in diameter or less, and a properly located “Y” branch is not available, the owner shall, at his or her expense, install a “Y” branch in the public sewer at the location specified by the Inspector. Where the public sewer is greater than 12 inches in diameter, and no properly located “Y” branch is available, a neat hole may be cut in the public sewer to receive the building sewer, with entry in the downstream direction at an angle of about 45 degrees. A 45-degree ell may be used to make such connection, with the spigot end cut so as not to extend past the inner surface of the public sewer. The invert of the building sewer at the point of connection shall be made at the top one-quarter of the public sewer. A smooth neat joint shall be made, and the connection made secure and water tight by resilient gaskets, epoxy cements, or encasement in concrete. Special fittings may be used for the connection only when approved by the Inspector.
   (M)   No person shall make connection of roof downspouts, basement drains, sump pumps, exterior foundation drains, areaway drains, or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a public sanitary sewer.
   (N)   The connection of a building sewer into the public sewer shall conform to the requirements of the building and plumbing code or other applicable rules and regulations of the town, or the procedures set forth in appropriate specifications of the American Society of Testing Materials and the Water Pollution Control Federation Manual of Practice No. MOP9. All such connections shall be made gas tight and water tight. Any deviation from the prescribed procedures and materials must be approved by the Inspector before installation.
   (O)   The applicant for the building sewer permit shall notify the said Inspector when the building sewer is ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the Inspector of his or her representative.
   (P)   All excavations for building sewer installation shall be adequately guarded with signs, barricades, and lights so as to protect the public from hazard. Streets, sidewalks, parkways, and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the town. All signs, barricades, and lights shall be in good condition and conform to the Indiana Manual on Uniform Traffic Control Devices.
