§ 156.065  C3 DISTRICT; INTENT; PERMITTED USES; SPECIAL EXCEPTION USES; STANDARDS.
   (A)   District intent.
      (1)   The “C3” (Industrial Park/Heavy Industrial) District is intended to provide a land use category for most moderate to high impact industrial park and heavy Industrial facilities. This district can be used adjacent to the “C1” and “C2” Commercial Districts and agriculture districts where there are not negative effects on the environment.
      (2)   The town’s Plan Commission and Board of Zoning appeals should strive to use the “C3” District on a case-by-case basis. Vacant land should not be zoned “C3”.
      (3)   The Plan Commission and Board of Zoning Appeals should be very careful in allowing this district. Environmental, public safety, public welfare and protection from all forms of pollution should be the highest priority. The Plan Commission and Board of Zoning Appeals should also strive to minimize lighting, parking lots fronting the major streets, excessive use of signs and traffic conflicts in the “C3” District.
      (4)   Buffer yards are mandatory and outdoor storage is not permitted.
   (B)   Permitted uses.
      (1)   Agricultural uses/service: farm equipment sales/service storage of agricultural products;
      (2)   Business; general business:
         (a)   Trade shops;
         (b)   Warehouse;
         (c)   Mini-storage facility; and
         (d)   Welding.
      (3)   Communication/utility:
         (a)   Radio/TV station; and
         (b)   Telephone exchange.
      (4)   Industrial uses:
         (a)   Bottled gas storage/distribution;
         (b)   Distribution center;
         (c)   Flex-space;
         (d)   Heavy manufacturing;
         (e)   Light manufacturing;
         (f)   Office complex; and
         (g)   Research center.
      (5)   Institutional/public facilities: public park/recreation center; and
      (6)   Miscellaneous: accessory uses.
   (C)   Special exception uses.
      (1)   Agricultural uses/service: processing agriculture products;
      (2)   Business; auto sales/services:
         (a)   Automobile body/shop (enclosed);
         (b)   Automobile repair, major (enclosed); and
         (c)   Automobile/truck storage (outdoor).
      (3)   Business; general business: storage (indoor or outdoor with XX screening);
      (4)   Communication/utility:
         (a)   Cellular/communication/radio/television tower;
         (b)   Electrical generator;
         (c)   Pipeline pumping station;
         (d)   Public wells;
         (e)   Sewage treatment plants;
         (f)   Storage tanks non-hazardous; and
         (g)   Utility substation.
      (5)   Institutional/public facilities: police/fire station;
      (6)    Industrial uses:
         (a)   Incinerator; and
         (b)   Liquid fertilizer storage/distribution.
      (7)   Miscellaneous: artificial lake, one or more acres.

   (D)   C3 District standards.
      (1)   Minimum lot area: three acres;
      (2)   Minimum lot width: 250 feet;
      (3)   Maximum lot depth: three times the lot width;
      (4)   Minimum lot frontage: 50 feet on a public street with access from said public street;
      (5)   Sewer and water: requires municipal water or sewer hookup;
      (6)   Minimum front yard setback:
         (a)   Sixty feet when adjacent to a primary arterial;
         (b)   Fifty feet when adjacent to a secondary arterial;
         (c)   Fifty feet when adjacent to a collector; and
         (d)   Fifty feet when adjacent to a local street.
      (7)   Minimum side yard setback: 30 feet (plus buffer yard);
      (8)   Minimum rear yard setback: 30 feet for the primary/accessory structure (plus buffer yard);
      (9)   Maximum lot coverage: square feet of all primary and accessory structures, and impervious surface cannot exceed 65% of the lot area;
      (10)   Minimum floor area: 5,000 square feet for primary structures;
      (11)   Maximum structure height:
         (a)   Thirty-five feet for the primary structure;
         (b)   Twenty-five feet for accessory structures; and
         (c)   Sixteen feet for towers/antennas.
