§ 156.043  R3 DISTRICT; INTENT; PERMITTED USES; SPECIAL EXCEPTION USES; STANDARDS.
   (A)   District intent.
      (1)   The “R3” (Medium Lot, Medium Home) District is intended to provide a land use category for medium lots and medium-sized single-family detached homes. The provisions that regulate this land use district should protect, promote and maintain areas in the town for existing and future housing growth.
      (2)   The town’s Plan Commission and Board of Zoning appeals should strive to protect this district from conflicting land uses and non-family oriented businesses.
      (3)   The Plan Commission and Board of Zoning Appeals should strive to promote an average net density of 2.5 to 3.5 dwelling units per acre community-wide in the “R3” District.
   (B)   Permitted uses.
      (1)   Residential:
         (a)   Dwelling, single family;
         (b)   Residential facility for developmentally disabled (small)*; and
         (c)   Residential facility for mentally ill*.
      (2)   Institutional/public facilities: public park/recreation center;
      (3)   Miscellaneous:
         (a)   Accessory uses; and
         (b)   Home occupation #1.
   (C)   Special exception uses.
      (1)   Residential:
         (a)   Dwelling, two-family**;
         (b)   Bed and breakfast facility;
         (c)   Boarding house**;
         (d)   Child care home (owner occupied, home)**; and
         (e)   Residential facility for developmentally disabled (large).
      (2)   Business; recreation: golf course;
      (3)   Institutional/public facilities:
         (a)   Fire station **;
         (b)   Church**;
         (c)   School, public or private **;
         (d)   Child care center **;
         (e)   Community center **; and
         (f)   Government building**.
      (4)   Communication/utility: public well; and
      (5)   Miscellaneous: home occupation #2.
   NOTE: *These uses are permitted by Indiana Code (I.C. 12-28-4-8 and I.C. 12-28-4-7).

   (D)   R3 District standards.
      (1)   Minimum lot area: 10,000 square feet;
      (2)   Minimum lot area per dwelling unit: 10,000 square feet;
      (3)   Minimum lot width: 80 feet;
      (4)   Maximum lot depth: two and one-half times the lot width;
      (5)   Minimum lot frontage: 50 feet on a public street with access from said public street;
      (6)   Sewer and water: requires municipal water and sewer hookup;
      (7)   Maximum structure height:
         (a)   Thirty-five feet for the primary structure; and
         (b)   Thirty feet for accessory structures.
      (8)   Minimum front yard setback:
         (a)   Fifty feet when adjacent to a primary arterial. Driveways are not permitted off of a primary arterial;
         (b)   Forty-five feet when adjacent to a secondary arterial. Driveways are not permitted off of a secondary arterial;
         (c)   Thirty-five feet when adjacent to a collector; and
         (d)   Thirty-five feet when adjacent to a local street.
      (9)   Minimum side yard setback: 15 feet;
      (10)   Minimum rear yard setback:
         (a)   Twenty-five feet for primary structures; and
         (b)   Twenty feet for accessory structures.
      (11)   Maximum lot coverage: square feet of all primary and secondary structures and impervious surface cannot exceed 45% of the lot area;
      (12)   Minimum main floor area:
         (a)   One thousand eight hundred square feet for one story primary structures; or
         (b)   One thousand three hundred square feet for the first floor of the primary structure; provided that, the total finished floor area is 1,800 square feet or more.
      (13)   (a)   Except for pipe stem lots, each lot created after the adoption of this chapter shall have 40 feet of frontage on a public road or a private road of at least a 50-foot right-of-way.
         (b)   To achieve more creative planning and preservation of natural property features, pipe stem lots are permitted; provided, they have exclusive unobstructed private easement of access of at least 25 feet width to a road. However, two pipe stem lots with no more than one dwelling on each lot may share a common easement of access of at least 25 feet in width. The area of a pipe stem lot occupied solely by the pipe stem driveway or easement shall not be deemed to be part of the required minimum lot area.
