§ 93.10  PERMIT REQUIRED.
   (A)   Within the town limits, no underground storage tanks used for the storage of gasoline, diesel fuel, gasohol, alcohol or any other type of liquid which is flammable or which may be used for internal combustion engines may be installed or used within a residential district within the town as they are not designated, or as they may be designated in the future, unless the storage tanks are for home heating oil only and are connected only to a furnace or heating device with no outside dispenser, or unless the owner of the property on which the tank is placed first receives a permit from the town’s Volunteer Fire Department and the state’s Fire Marshal.
   (B)   Permits for the installation of underground storage tanks may be obtained from the Fire Chief and shall be accompanied by a fee to cover the actual cost of inspections as the fee may be set from time to time by resolution of the Town Council. The fee is hereby set at $100 for the initial installation of equipment and at $25 for an annual inspection thereafter.
   (C)   Any permit for underground storage tanks shall be issued only on the approval of the Fire Chief and on his or her determination that the applicant has complied with all necessary regulations and fee requirement.
