§ 92.47  NOTICE TO REMOVE.
   (A)   Pursuant to I.C. 36-7-10.1, the Town Council shall require the owners of real property in the town to cut and remove weeds, grasses or other rank vegetation growing on that property. The Town Police Department shall be responsible for identifying and issuing citations and other notices to properties determined to be in violation of these provisions.
   (B)   From the date the notice of violation is mailed, the property owner has ten days to abate the violation. After ten days, the town will perform a site inspection. If the property owner has abated the violation (mowed the property), the town will note in its file that the property owner has come into compliance, and the violation is closed. If the property owner fails to abate the violation, the town will document the violation via photography and immediately mow the property. The town shall maintain before and after photographs.
   (C)   If the initial notice of violation of this subchapter was provided by first class mail or any other manner permitted by I.C. 36-7-10.1-3, a continuous abatement notice may be posted at the property by the Police Department at the time of abatement instead of by first class mail or equivalent service as required under this subchapter. A continuous abatement notice serves as notice to the landowner that each subsequent violation during the same year for which the initial notice of the violation was provided may be abated by the town or its contractors.
