§ 12.04  PRESUMPTION THAT UNIT HAS POWERS NECESSARY TO CONDUCT AFFAIRS.
   (A)   A unit has all powers granted it by statute, and all other powers necessary or desirable in the conduct of its affairs.
   (B)   A unit may exercise any power it has to the extent that the power is not expressly denied by the state’s Constitution or by statute, and is not expressly granted to another entity.
