§ 52.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person found to be violating any provisions of §§ 52.25 through 52.35 of this chapter, except § 52.33 of this chapter, shall be served by the town with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
      (2)   Any person who shall continue any violation (other than a violation of § 52.26(A)(2) of this chapter) beyond the time limit provided for in division (B)(1) above shall be guilty of a misdemeanor and, on conviction thereof, shall be fined in an amount not exceeding $2,500 for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
      (3)   Any person violating any of the provisions of §§ 52.25 through 52.35 of this chapter shall become liable to the town for any expense, loss or damage occasioned the town by reason of such violation.
      (4)   (a)   Any person violating or suspected of violating § 52.26(A)(2) of this chapter, shall be subjected to a penalty of $50 per month (or fraction thereof in which the violation occurs).
         (b)   A person may avoid payment of said penalty by consenting to an inspection described in § 52.28 of this chapter, for the purpose of establishing compliance with § 52.26(A)(2) of this chapter.
         (c)   A person consenting to such an inspection and found in violation shall be given 90 days to comply with § 52.26(A)(2) of this chapter without being subject penalty.
