(A) The Director or designee is authorized upon presentation of identification to enter construction sites at reasonable hours in order to conduct inspections for the purpose of determining compliance with the construction general permit. The Director or designee is authorized to take photographs and collect other information reasonably necessary to determine compliance with this Article.
(B) If the Director or designee is refused access to any construction site and can demonstrate a probable cause to believe that a violation of this Article has occurred or is occurring, the Director may request the issuance of a search warrant from the Apache Junction Municipal Court.
