§ 3-1-202. Advertisements.
   (a)   Publication. Whenever the law requires advertisement of notice of an appeal to the Board of Appeals that relates to a rezoning, critical area reclassification, or a special exception, the advertisement shall be published in the manner specified in this section.
   (b)   Distribution of publication. The advertisement shall be published in the newspaper or newspapers published in the County that, in the judgment of the Purchasing Agent, will result in the widest distribution of the notice to the residents of the County. In determining the newspaper or newspapers in which to publish the advertisement, the Purchasing Agent may not consider the advertising costs of competing newspapers unless the Purchasing Agent determines that the competing newspapers would provide equal distribution of notice.
   (c)   Compliance with law. The advertisement shall be published at the times and in the newspaper or newspapers required by other provisions of law relating to the advertising of notice of appeals that relate to rezonings, critical area reclassifications, and special exceptions.
   (d)   Form and information. The advertisement shall be a display advertisement and shall be in substantially the form and contain the information specified below:
NOTICE OF HEARINGS
REZONINGS, CRITICAL AREA RECLASSIFICATIONS , AND SPECIAL EXCEPTIONS
ANNE ARUNDEL COUNTY, MARYLAND
   The following case(s) will be heard before the Board of Appeals:
   Address of the subject property (if available)
   Case and file numbers (including case number before the Administrative Hearing Officer)
   Name of applicant
   Nature of appeal
   Location of property (including tax assessment district and nearest intersecting roadway)
   Date, time, and location of hearing
   Further information on the case(s) listed above may be obtained from the Office of Planning and Zoning (telephone number).
   (e)   Certification to Board of Appeals. The Purchasing Agent shall certify, in writing, to the Board of Appeals that the advertisement has been published in accordance with this section. The written certification shall be prima facie evidence that the advertisement has been published in accordance with this section.
   (f)   Certification condition precedent to hearing. The Board of Appeals may not conduct a hearing on an appeal that relates to a rezoning, critical area reclassification, or a special exception unless the Purchasing Agent certifies that advertisement of the appeal has been published in accordance with this section.
