§ 17-7-906. Inclusionary housing.
   For development on a site with 20 or more dwelling units, 10% of the dwelling units shall:
      (1)   be encumbered by a recorded restrictive covenant enforceable by the County or its designee that shall:
         (i)   require home ownership units be occupied by a household with an income that does not exceed 100% of the median income adjusted for household size for the Baltimore Primary Metropolitan Statistical Area, as defined and published annually by the United States Department of Housing and Urban Development;
         (ii)   require rental units be occupied by a household with an income that does not exceed 60% of the median income adjusted for household size for the Baltimore Primary Metropolitan Statistical Area, as defined and published annually by the United States Department of Housing and Urban Development; and
         (iii)   comply with the conditions set forth in § 18-10-174(2)(i), (iii), and (iv), of this Code;
      (2)   comply with the conditions set forth in § 18-10-174(8) of this Code; and
      (3)   have home prices set at rates certified by the County or its designee to be affordable to a household with an income that does not exceed 80% of the median income adjusted for household size for the Baltimore Primary Metropolitan Statistical Area, as defined and published annually by the United States Department of Housing and Urban Development.
