(a) Written demand to remedy. If the Information Technology Officer determines that a franchisee has failed to perform any obligation under the franchise or has failed to perform in a timely manner, the Officer may make a written demand on the franchisee that it remedy the violation. If the violation is not remedied or in the process of being remedied to the satisfaction of the Information Technology Officer within a reasonable time following the demand, the Officer may:
(1) assess against the franchisee monetary damages as provided in § 10-11-102;
(2) request revocation of the franchise as provided in § 10-11-103; or
(3) pursue any legal or equitable remedy available under the franchise agreement or any applicable law.
(b) Remedies cumulative. Remedies available to the County for franchise violations under this article and under a franchise agreement shall be construed, except as otherwise provided in this article, as cumulative and not alternative.
