(a) Generally. Unless a franchise has been granted in accordance with the provisions of this article, a person may not construct or operate a cable system in the County; provided however, that a telecommunications or other communications system operating in the County pursuant to other legal authority may be upgraded or extended consistent with that legal authority so that the system can be used to provide cable service without first obtaining a cable franchise, but cable service cannot be offered or provided in the County and plant that will be used only for cable service cannot be installed in the County without first obtaining a franchise in accordance with the provisions of this article.
(b) Sanctions for violation. In addition to any other remedy available to the County, a person who violates this section is liable for a civil penalty of $1,000 for each day the violation continues.
