§ 10-1-106. Information Technology Officer's authority.
   (a)   Regulatory authority. The Information Technology Officer shall exercise regulatory authority under the provisions of this article and applicable law.
   (b)   Exercise of authority. Unless otherwise expressly provided, the Information Technology Officer shall exercise or discharge all rights, actions, and obligations conferred on the County under this article.
   (c)   Adoption of regulations. After an opportunity for comment from the public and franchisees, the Information Technology Officer may adopt regulations to accomplish the purposes and effectuate the provisions of this article.
   (d)   Judicial review of decisions. Unless this article or the franchise agreement provides for a different method of review or resolution, a decision by the Information Technology Officer is subject to judicial review in the Circuit Court for the County or in the United States District Court for the District of Maryland, and the purpose of the review shall be to determine whether the Officer acted beyond the scope of the Officer's legal authority or in an arbitrary, capricious, or unreasonable manner.
